BARA ANDRADA PERSOANA FIZICA AUTORIZATA (referred to as "ABK Pilates," "we," "our," or "us") provides an online wellness platform offering Pilates classes, meditation, nutrition content, and occasional in-person events (collectively, the "Services") through our website and associated services (collectively, the "Platform").
BY USING OUR PLATFORM OR SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
DISCLAIMER
The content on the Platform is provided for general informational purposes only and is not medical advice. You should consult with a qualified healthcare professional before starting any fitness, nutrition, or wellness program. By using the Platform, you assume full responsibility for your decisions and actions.
You affirm that either:
• No healthcare provider has advised you against physical activity,
• You have consulted with a healthcare provider and have been cleared to use the Services.
If you are pregnant, nursing, elderly, or have any chronic conditions, you must consult a healthcare provider before engaging with our content.
We disclaim all liability for any injuries or health issues you may experience through use of the Platform.
LICENSE
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use, provided you comply with these Terms. All intellectual property remains ours.
ACCOUNT SECURITY
You are responsible for all activity that occurs under your account, including, but not limited to, any activity by unauthorized users. You may not allow others to use your account; this includes, but is not limited to, furnishing your username and password to third-party developed applications to connect to your account for any reason. You must safeguard the confidentiality of your password, and if you are using a device that others have access to, log out of your account after using the Service. If you become aware of unauthorized access to your account, change your password and notify our support team immediately.
SUBSCRIPTIONS & BILLING
Subscriptions include a 7-day free trial. After the trial, your selected plan (monthly, quarterly, or yearly) will automatically renew at the current rate unless you cancel before the renewal date.
You are solely responsible for managing and cancelling your subscription via your account settings. To avoid being charged, cancellation must be completed before the start of the next billing cycle. Cancellations made after the renewal period has begun do not qualify for refunds under any circumstances. You may cancel anytime through your account before the next billing period. If a payment attempt fails at the start of a new billing cycle, our system will automatically retry the charge up to two times. If the second retry attempt is failed, your subscription will automatically be cancelled.
All payments are securely processed via Stripe. We do not offer partial or full refunds once a payment is successfully processed.
ELIGIBILITY
You must be at least 13 years old to use the Platform. If under 18, parental permission is required.
INTELLECTUAL PROPERTY
All content, branding, and materials on the Platform are owned or licensed by us and protected under intellectual property laws. You may not copy, redistribute, or modify any content without our express permission.
USER CONTENT
If you submit comments, feedback, or suggestions, you grant us an unlimited license to use them for any purpose. You remain responsible for all content you submit and must not post anything unlawful, abusive, or infringing.
PROHIBITED USES
You may not:
• Use the Platform for unlawful purposes,
• Share your account access,
• Post harmful, illegal, or offensive content,
• Attempt to reverse-engineer or disrupt the Platform.
We reserve the right to terminate accounts violating these rules.
LINKS TO OTHER SITES
We are not responsible for third-party websites linked on the Platform. Visiting them is at your own risk.
NO WARRANTIES
The Platform and content are provided "AS IS" without warranties of any kind. We do not guarantee availability, accuracy, or suitability for your personal needs.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages. Our maximum liability shall not exceed the amount paid by you in the previous 12 months.
ARBITRATION AGREEMENT & CLASS ACTION WAIVER
Any disputes between you and us will be resolved by individual binding arbitration under applicable rules. You waive the right to participate in a class action or jury trial. Exceptions apply for small claims and intellectual property matters.
Before starting arbitration, you must notify us in writing and attempt informal resolution. If unresolved after 45 days, arbitration may begin.
GOVERNING LAW
These Terms are governed by Romanian law, unless otherwise required by applicable consumer protections in your country.
TERMINATION
We may suspend or delete your account at our discretion, especially if you violate these Terms. Termination does not affect rights accrued before termination.
